NOTICE OF MORTGAGEE‘S SALE
By virtue of and pursuant to a power of sale contained in a certain Mortgage Deed dated August 16, 2013 given by Janet L. Pulling (single) to the United States of America, acting through the Rural Housing Service, United States Department of Agriculture, whose address is Rural Housing Service, c/o Centralized Servicing Center, United States Department of Agriculture, 4300 Goodfellow Blvd., Bldg. 105, St. Louis, Missouri 63120, having been recorded in the Registry of Deeds, County of Grafton and State of New Hampshire, in Book 4005, Page 707, Rural Housing Service for New Hampshire, United States Department of Agriculture, will sell at
PUBLIC AUCTION
on the premises located at 19 School Street, Canaan, New Hampshire on November 8, 2018 AT, 11:00 AM the following described real estate:
A certain tract or parcel of land, with the buildings or improvements thereon, situate in Canaan, in the County of Grafton and State of New Hampshire, more particularly bounded and described as follows, to wit:
Beginning at an iron pin on the north side of School Street and the southeast corner of the lot now or formerly of William Withington;
Thence northerly along said Withington land a distance of 217 feet to an iron pin;
Thence easterly along land now or formerly of Ralph T. Barney 55 feet to a stake;
Thence southerly 216 feet to a stake beside School Street;
And thence westerly along said School Street 55 feet to the point of beginning.
Subject to the rights of the Town of Canaan in and to a drainage ditch crossing the herein conveyed premises, if any such right exists.
Subject to the easement for septic tank and connection line granted to the Town of Canaan by quitclaim deed of Dana Clark and Michelle Clark, dated July 13, 1998 and recorded with the Grafton County Registry of Deeds at Book 2331, Page 753.
Meaning and intending to describe all the same premises conveyed to Janet L. Pulling by Warranty Deed of Jonathan F. Roberts, dated August 16, 2013 and recorded in the Grafton County Registry of Deeds on August 20, 2013 at Book 4005, Page 707.
The sale is made under the power and authority contained in said Mortgage and is for condition broken, namely failure to make payments of principal and interest when due and for foreclosure of all rights of redemption of said mortgagors and all persons claiming under them.
MEANING AND INTENT:
Said premises will be sold ”as is“ in all respects, and subject to any condition which a title search would reveal; all unpaid real estate taxes and liens, whether or not of record; any facts which an inspection or survey of the premises might show; all mortgages, tax or other liens, attachments and all other encumbrances and rights, title and interest of third persons of any and every nature whatsoever which are, or may be entitled to precedence over the mortgage deed; and subject to any existing tenants, tenancies or persons in possession.

YOU ARE HEREBY NOTIFIED THAT YOU HAVE A RIGHT TO PETITION THE SUPERIOR COURT FOR THE COUNTY IN WHICH THE MORTGAGED PREMISES ARE SITUATED, WITH SERVICE UPON THE MORTGAGEE, AND UPON SUCH BOND AS THE COURT MAY REQUIRE TO ENJOIN THE SCHEDULED FORECLOSURE SALE.
TERMS OF SALE AND DEPOSIT:
Purchaser shall provide a $5000.00 deposit in cash, certified check or bank check at time and place of sale, and for which the individual conducting the sale will issue a receipt. Deposit is to be in the form of a certified bank check drawn to the order of Paul McInnis Inc., Escrow Account. Balance due at closinq, at the office of buyer‘s closing agent, within thirty (30) days of the date of sale, upon tender of the Mortgagee‘s Foreclosure Deed. Subject to all Terms of Sale. The balance of the purchase price shall be paid in full in the form of a certified bank check, said certified bank check should be drawn to the order of the USDA - Rural Housing Service. Subject to errors, omissions, taxes, and prior liens. TIME IS OF THE ESSENCE. The purchaser shall execute a memorandum of sale with the seller immediately after the sale occurs. If the purchaser fails to complete the purchase of the mortgaged premises within thirty (30) days of closing and on the terms outlined herein, said purchaser shall be in default, and the mortgagee may, at its option, retain the deposit, as liquidated damages.
By virtue of and pursuant to delegated authority appearing in 7 C.F.R. 1800.22(i), the United States of America, acting by and through the Branch Director of the Rural Housing Service, United States Department of Agriculture, has caused this Notice of Mortgagee‘s Sale to be executed on this 20th day of September, 2018.
